A federal judge on Thursday permanently dismissed criminal charges against former U.S. Olympian David Hearn, who had been accused of damaging the Lincoln Memorial Reflecting Pool. U.S. District Judge Todd Edelman issued the dismissal with prejudice, ensuring that the government cannot bring the same charges against Hearn in the future.
The ruling follows mounting controversy surrounding political interference in the judicial process. The Justice Department had previously moved to drop the case after discovering new evidence showing that the alleged damage was actually caused during standard renovation work rather than vandalism. However, federal prosecutors initially sought a dismissal without prejudice, hoping to keep the option open to refile charges if circumstances changed.
Political Pressure and Judicial Independence
Judge Edelman strongly rejected the prosecution’s request, highlighting undue pressure from President Donald Trump. Trump has publicly downplayed documentation proving the damage occurred during renovations and openly criticized the decision by D.C. U.S. Attorney Jeanine Pirro’s office to drop the case. The President even publicly entertained the possibility of firing Pirro following the dismissal.
“In securing the Indictment against Mr. Hearn, the government shot first and asked questions later,” Judge Edelman wrote in his scathing opinion. He added that nothing in the grand jury process would prevent authorities from yielding to presidential pressure and indicting Hearn a second time if the case were not dismissed with prejudice.
The judge further noted that while prosecutors assigned to the case recognized it as entirely meritless, they faced continuous public disparagement and coercion from the White House to reverse their course. Edelman concluded that any future prosecution based on the current trajectory was not only theoretical but entirely fanciful.
